Borssele to stay in Dutch hands, rules court

RWE has lost a legal battle to claim a 50 per cent stake in the Netherlands' Borssele nuclear power plant after a ruling was upheld by an appeal court.
The Arnhem appeal court's ruling prohibits the Germany utility from acquiring Essent's 50 per cent stake in the nuclear plant, and will ensure that the facility remains in Dutch hands. RWE wanted to acquire the plant as part of its takeover of Dutch utility Essent last year.
According to Delta, the Dutch utility that owns half of Borssele, the appeal court emphasised in its ruling that the country's sole nuclear power plant should remain in public ownership. Delta has announced plans to build a second nuclear power plant at the site.
In 2009 the transaction price of RWE's takeover of Essent was dropped by €950 million due to the exclusion of Borssele from the deal. Essent's share in the plant has remained in the hands of the provincial and municipal governments who were the company's original public shareholders.
